Law Student Adds Economics to Hall Street Discussion
The National Arbitration Forum Blog: David Kessler (Harvard Law School, J.D. 2009) has taken a law-and-economics approach to analyzing the much talked about Supreme Court arbitration decision, Hall Street Associates, L.L.C. v. Mattel, Inc. He challenges whether the Court’s decision, which effectively limits judicial review, will actually create "efficient" outcomes. In the short term? Maybe. In the long term? Maybe not.
